Texas
family law has a presumption that a child's parents will share joint legal custody, but joint
custody does not require the judge to award each parent equal time with the
child. Normally one parent has the right to determine the
child's primary home, and the judge will grant the other parent a specific
visitation schedule. If the parties don't agree on
a visitation schedule that is workable for everyone, the Court will hear
evidence and make a decision that the judge believes is best for the child,
even if it may seem unfair to one of the parents. Visitation can be
restricted, and the judge can even order supervised visitation, if the judge
believes this is necessary to protect a child from harm.
For children of divorce to grow up as healthy
individuals, judges are aware that it is important for the children to have
a relationship with both parents. The
Texas Standard Possession Order sets out the presumptive minimum amount
of possession for the non-custodial parent. Whenever the parties
agree to deviate from this schedule, they may do so. Children who have
frequent contact with both parents are significantly happier and healthier
than children who do not. Divorced parents who are successful at co-
parenting their children will learn to be flexible with each other as
scheduling conflicts arise, and will invite the child's other parent to be
active in the child's activities beyond the strictures of the Court ordered
visitation schedule.
